In Irkutsk, a dispute has flared over building a house on Siberian Street between dilapidated homes. Nearby residents are outraged, while the developer insists he is acting within the law. Meanwhile, the Oktyabrsky District Court banned the work, since instead of an allowed three story building they tried to erect a four or five story one, and the owner had already been ordered to stop construction.
The building on Siberian Street is being erected between dilapidated residential buildings. Residents of several nearby houses are outraged by this, but a specialist from the company "Siticom," which is carrying out the construction of the building, stated that the construction is being carried out within the law, and the neighbors are complaining "out of spite."The construction of the building between the dilapidated houses on Siberian Street was prohibited by the Oktyabrsky District Court of Irkutsk. This court decision is related to the fact that the developer, instead of the three-story structure permitted by the city administration, decided to erect a four- or five-story building.
With respect to the owner, Yuri Alekseevich Egorov, an administrative case was initiated under Article 9.5 of the Code of Administrative Offenses of the Russian Federation (violation of the established procedure for the construction, reconstruction, major repairs of a capital construction facility, and putting it into operation), and an order was issued to stop the construction.
Since the owner did not stop the construction work, the administration of Irkutsk filed the relevant lawsuit in court. In April 2015, the Oktyabrsky District Court granted the mayor's office's petition. In May 2015, by ruling of the Oktyabrsky District Court, the defendant's motion to lift the interim measures was denied.
