The Oktyabrsky District Court of Irkutsk granted the claim of a 57-year-old woman against Irkutskavtotrans for recovery of insurance compensation, as well as compensation for moral damages.
In the winter of 2013 in Irkutsk, a bus driver violated traffic rules and collided with another vehicle. As a result of the road accident, the Irkutsk woman sustained injuries.
The woman applied to the insurance company with a request for compensation payment, but was denied because the carrier’s civil liability in operating the bus at the time of the accident had not been insured. In such cases, by law, insurance compensation is recovered from the carrier, the press service of the Irkutsk Region Prosecutor’s Office explains.

In favor of the injured woman, the court ordered the enterprise Irkutskavtotrans to pay insurance compensation in the amount of 442 thousand rubles, as well as moral damages in the amount of 200 thousand rubles.
In addition, the court ordered the transport enterprise to pay a fine of 221 thousand rubles because the injured woman’s claim for compensation for damages was not resolved by the defendant voluntarily.
